Security deposits in India: how much, and how to get yours back

What's usual in different cities, what an owner can fairly deduct, and the habits that make the refund smooth.

For most tenants in India the security deposit is the biggest single payment of a move, often more than several months' rent put together. It is also the most common reason tenants and owners fall out at the end. This guide covers what to expect, what to put in writing and what to do on the day you leave. How much deposit is normal?

For most tenancies there is no single national rule, so the deposit comes down to local custom and what you agree with the owner. Broadly:

  • Bengaluru is known for the highest deposits in India. Several months' rent is common, and some owners still ask for up to ten months.
  • Some other cities, such as Chennai, have traditionally asked for larger advances too.
  • In Mumbai, Pune, Delhi NCR, Hyderabad and most other cities, deposits are usually lower, often two or three months' rent, though they vary by owner, locality and furnishing.
  • PGs and co-living spaces usually ask for one or two months' fee.

It's often negotiable

Fully furnished flats tend to come with higher deposits. Owners are often willing to accept less for a tenant with a steady job, a longer commitment, or rent paid on time by standing instruction. Ask politely, and if you agree a lower deposit, make sure the agreement shows the lower figure.

Is there a legal limit?

The central Model Tenancy Act, 2021 suggests capping deposits for homes at two months' rent, but it applies only in states that adopt it, and states can adapt it. Some states have rent laws of their own. If the amount asked seems out of line, check your state's current rules.

Put the deposit terms in writing

  • The exact amount, and proof you paid it: a bank transfer or UPI reference, or a signed receipt
  • When it will be returned after you hand over the keys, for example on the day or within a set number of days
  • What can be deducted: unpaid rent or bills, and damage beyond normal wear and tear
  • Painting and cleaning charges as the actual cost or a fixed amount, not 'as decided by the owner'
  • Whether the deposit can be adjusted against the last months' rent (only if you both agree)

On move-in day: record the condition

Your best protection is evidence from day one. Before you unpack:

  • Take dated photos and a slow video of every room: walls, floors, bathroom fittings, the kitchen, windows and appliances
  • List existing damage, such as cracks, stains, broken tiles or a geyser that doesn't heat
  • Note the electricity meter reading
  • Send the photos and the list to the owner on WhatsApp or by email the same day, and ask them to acknowledge
  • Keep a list of fittings and furniture signed by both of you

During your stay

Pay rent by bank transfer or UPI so there's a record. Report problems in writing (a WhatsApp message counts) and keep receipts for any repair the owner agreed to pay you back for. Don't drill, paint or make other changes without written permission.

On move-out: get it back

  • Give notice in writing, as the agreement requires, and confirm the handover date
  • Clear electricity, water, gas, internet and maintenance dues, and keep the final bills
  • Clean the flat and fix small damage you caused
  • Walk through the flat with the owner, take the same photos and video again, and agree any deductions there and then
  • Hand over every key and access card against a written acknowledgement
  • Ask for the refund by bank transfer, with a written breakdown of any deduction

If the owner won't return it

Start with a polite written request listing what you're owed, with your move-in and move-out photos and receipts attached. If that doesn't work, a legal notice from a lawyer often settles it. Beyond that, depending on your state, the dispute may go to a civil court or a rent authority. A local lawyer can tell you which route applies and whether it's worth it for the amount.

Common questions

Can the owner deduct painting charges from my deposit?

Only if your agreement allows it. Many Bengaluru agreements include a painting charge; if yours does, agree the actual cost or a fixed amount before you sign, rather than an open-ended deduction.

Can I use my deposit as the last months' rent?

Only if the owner agrees in writing. Many owners won't, because the deposit is there to cover damage and unpaid bills.

Does the owner pay interest on the deposit?

Usually not. Most agreements describe the deposit as interest-free and refundable, unless your agreement or your state's law says otherwise.

How long can an owner take to return the deposit?

Whatever your agreement says. Many agreements say it is returned when you hand over the flat, after deductions. If yours doesn't say, agree a date in writing before you move out.
